Therefore we invite you to read and accept them in order to proceed with the purchase.

I – SUBJECT

These general conditions of sale govern the sale of the products marketed by Sciarra Lift, based in C.da San Giovanni 94, 64010 Colonnella (TE) Fiscal Code and VAT number 01623440672, through the website www.sciarralift.it to users and users who act for business-related purposes.

These general conditions have effect from the date of acceptance of the same by the customer on the site, which is in effect as acceptance pursuant to art. 1341 of the civil code.

The Company reserves the right to modify these general conditions of sale at any time, reporting them to the site.

Any contractual or extra-contractual liability for the Company is excluded for direct or indirect damages to persons and / or property caused by the non-acceptance, even partial, of an order.

II – PURCHASE METHODS The purchase of the products takes place through access to the site and the related registration. For each of the products a description is available on the site containing the main characteristics of the same. All purchase support information is intended as a simple general information material. It is understood that the image accompanying the product description may not be fully representative of its characteristics, but differ in color, size, accessory products in the figure. The correct reception of the order is confirmed by Sciarra Lift through an automatic reply by e-mail, sent to the e-mail address communicated by the customer at the time of registration. This confirmation message will include an “order number”, to be used in the case of any communication with the company. The message will report all the data entered by the customer who undertakes to verify its correctness and to promptly communicate any corrections. In the case of payment by bank transfer, the customer will receive, by e-mail, the bank details to make the payment correctly. In case of non-acceptance of the order, Sciarra Lift guarantees timely communication to the customer.

III – TERMS OF PAYMENT All prices on the site are VAT excluded. Prices may vary without notice and the only correct price is to be considered as indicated at the time of order confirmation. On certain products, subject to price promotions, Sciarra Lift reserves the right to accept orders by reducing the quantity, subject to communication and acceptance by the customer, failing which the order will be considered canceled. In the case of purchase of goods with “credit card” payment methods, at the same time as the online transaction is concluded, the reference bank will authorize the sole commitment of the amount relative to the purchase made. The amount related to the goods received, even partially, will actually be charged to the customer’s credit card only upon delivery of the goods ordered to the courier. In the case of purchase of goods with payment methods “bank transfer” you can only credit after receiving the e-mail containing the bank details by Sciarra Lift. The purpose of the transfer must include the order number that will be communicated to you by e-mail. The transfer will be considered valid if made within 5 working days of receipt of the second e-mail. Within 2/5 working days from the execution, Sciarra Lift will verify the accreditation and send the goods, except for unforeseen events for which timely telephone and / or e-mail communication will be given.

Sciarra Lift reserves the right to cancel the order in case of non-receipt of the transfer. In the event that the amount of the transfer does not correspond to the amount of the order, Sciarra Lift will contact you to agree on how to proceed with the order.Customers are advised to keep a copy of the bank transfer receipt as proof of payment.For further information or to receive support, please contact Sciarra Lift at no. telephone 0861 700251 at the times indicated.The goods are sent only after receipt of the credit.In case of cancellation of the order, both by the customer and in case of non-acceptance of the same by Sciarra Lift, the cancellation will be made and the release of the amount involved (the time of release depends solely on the system banking). After the cancellation of the transaction, Sciarra Lift cannot be held responsible for any damage, resulting from the release of the amount committed by the banking system.In case of payment by bank transfer in advance, the amount ordered by the customer will be committed until receipt of the credit on the C / C and in any case no later than 7 days from the order.

IV – DELIVERY METHODSFor each order made Sciarra Lift issues sales document of the material shipped. For the issuance of the invoice, the information provided by the customer at the time of ordering shall prevail. The customer can request a copy of the invoice or tax receipt within three months of the issue.Delivery costs are charged to the customer and are indicated when the order is placed.No responsibility can be attributed to Sciarra Lift in case of delay in the order or delivery of the order. At the time of delivery the customer is required to check:- that the packaging is intact, neither damaged, nor wet, or otherwise altered;- that the number of packages corresponds to what is indicated in the transport document.Any damage to the product or the packaging or the mismatch of the indications must be immediately notified to the courier by placing the WRITTEN CONTROL RESERVE on the courier delivery test. Once the courier’s document has been signed, the customer cannot make any objection about the appearance of the goods delivered.In case of failure to collect within 5 working days of the material in storage at the warehouses of the courier because of repeated inability to deliver to the address specified by the customer when ordering, the order will be canceled.

V – RIGHT OF WITHDRAWAL Pursuant to and within the limits of art. 64 of Legislative Decree 6 September 2005, n. 206, the customer has the right, within 10 working days from receipt of the purchased products, to exercise the Right of Withdrawal, consisting in the faculty to return the products received and to obtain the reimbursement of the price paid. This right applies to all products contained on the www.sciarralift.it website. Also pursuant to the aforementioned Legislative Decree 206/2005, it is specified that the Right of Withdrawal is exclusively reserved for consumer customers, ie only for natural persons who purchase products for their own use and act for purposes not related to their professional activity, or if they do not make the purchase indicating a VAT number when ordering. To make use of the Right of Withdrawal, the Customer must contact Sciarra Lift at no. telephone number 0861 700251. Subsequently the Customer must send a registered letter with return receipt to the following address: Sciarra Lift Contrada San Giovanni 64010 Colonnella (TE) – Italy The customer can anticipate the communication via e-mail at: info@sciarralift.it. Once the communication is received, Sciarra Lift will inform the customer of the methods and number of return.The customer must promptly send the shipment to the address communicated by Sciarra Lift. The transport costs and the responsibility of the goods during shipment, as required by law, are charged to the customer. It is therefore advisable to insure the products at the chosen courier, taking care to carefully pack the goods, where possible by inserting it in an external box, avoiding damaging the original packaging with adhesive tapes, labels, etc. The product must be returned intact in the original packaging complete with all its parts and accessories. In case of transport damage occurred during the return, Sciarra Lift will communicate the same to the customer within five working days of receipt of goods, allowing him to report to the courier used for transport. The damaged goods will be made available for return and the withdrawal request will be canceled at the same time.Subject to any reimbursement costs for ascertained damages, Sciarra Lift will refund within 30 days and in any case not before receiving the goods purchased the full amount of the asset by credit card transfer or bank transfer to the current account indicated by the customer. The right of withdrawal is lost if the products are returned damaged (for reasons other than transport) or incomplete.

VI – APPLICABLE LAW The sales contract between the customer and Sciarra Lift is concluded in Italy and governed by Italian law. Unless otherwise stated, the Italian Law on the subject applies. For the resolution of civil and criminal disputes arising from the conclusion of this contract of distance selling, if the customer is a consumer, ie a natural person who purchases the goods for purposes not related to his professional activity, or does not make the purchase indicating in the order a reference of VAT number, the territorial jurisdiction is that of the Forum of reference of its municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Teramo.

VII – INFORMATION REGARDING THE PROCESSING OF PERSONAL DATA SUBJECT: information and request for consent pursuant to and for the purposes of articles 13, 23 and 26 of Legislative Decree 30.6.2003 n. 196, concerning the protection of the processing of personal data. Sciarra Lift informs you pursuant to and for the effects of art. 13 of Legislative Decree no. 196/2003 that:

1) the aforementioned Legislative Decree provides a series of obligations for those who perform “treatments” (ie collection, recording, processing, storage, communication, dissemination, etc.) of personal data related to other subjects, prescribing the duty to inform interested parties about the rights that the law recognizes them and about the characteristics of data processing;

2) the processing of your personal data that will be requested and that will be communicated by you will be carried out in the premises of Sciarra Lift, Contrada San Giovanni 94 Colonnella (TE), in compliance with the principles of necessity and relevance with the use of procedures also computerized, for legal and tax obligations for the execution of contractual obligations;

3) the holder of the treatment is Sciarra Lift. The controller of data processing is domiciled for the purposes of the law at the headquarters of the same company. On the occasion of such processing, the data controller and the relative persons in charge may become aware of the data that will be processed in compliance with the obligations deriving from the privacy rules and according to principles of correctness;

4) the processing will take place with manual and automated systems designed to store, manage and transmit the data, with logic strictly related to the purposes of the processing, based on the data in our possession and with commitment from you to promptly notify us of any corrections, additions and / or updates;

5) excluding communications and disclosures made in compliance with legal and contractual obligations, the data provided to the undersigned will be used solely for the purposes of law;

6) the nature of the transfer is to be considered strictly necessary in relation to the purpose of the above mentioned treatments. The conferment by you of the aforementioned data is essential for the exact fulfillment of the activities listed above;

7) any refusal implies the impossibility of correctly fulfilling the contractual and legal obligations, compromising the continuation of the relationship established between the parties;8) at any time you can exercise your rights towards the data controller, pursuant to art. 7 of Legislative Decree 196/03, in particular of:- know the existence or not of personal data concerning you and their communication in an inteliable form;- be informed on the holder, on the purposes and methods of the processing and on the possible responsible, on the subjects or categories of subjects to whom the personal data can be communicated;- obtain the updating, rectification or integration of data;- obtain cancellation, transformation into anonymous form or blocking thereof;- to oppose the processing of data for legitimate reasons, without prejudice to the limits established by law;- oppose the sending of advertising material or for carrying out market.
